DEATH PENALTY BILL OK'D BY ASSEMBLY.(Local)

The state Assembly approved legislation Monday restoring the death penalty in New York state and sent it to Gov. Mario Cuomo's desk where it faces a certain veto.

It was the 12th straight year the Legislature approved a death penalty bill. Six times from 1977 to 1982 the measures were vetoed by former Gov. Hugh Carey and five times since then by fellow Democrat Cuomo.

As in years' past, the Democratic- controlled Assembly failed Monday to come up with the 100 votes needed in the 150-member house to override Cuomo's impending veto. The vote Monday was 92-53.
